3. Services and Costs
Services vary
with the individual tours and are listed in the respective tour descriptions. We
reserve the right to change our program and hotel accomodations due to
unforeseeable events, including weather, road conditions or other inhibiting
factors. In that case RMT shall endeavour to provide alternatives of equal
quality of services and tour character.
We reserve the right to adjust tour prices as required to
compensate for service provider rate increases. The tour participants are
notified of such cost increases as they become apparent, but not later than 30
days before start of travel. The tour participants are entitled to a refund of
the deposit or any further payment made if the increase exceeds 5% of the quoted
tour price.
Motorcycle adventure tours typically require a higher
degree of personal engagement by the participants than any ordinary organized
travel. There may be unforseeable and unplanned events which contribute to the
unique character of this tour. The tour participants are required to conduct
themselves in an orderly fashion and must follow the directions of the tour
guide. In order to prevent tour disruption, endangerment of others, and conduct
leading to other participant‘s dissatisfaction we will exercise the right to
exclude non-compliant tour participants from the tour and may deny further usage
of the rental vehicle. In this case those tour participants shall not be
refunded any money and are fully responsible for any further costs caused
thereof.
4. Rental
contract and security deposit
Upon take over
of the rental motorcycle, a safety deposit is payable and a rental contract has
to be signed. The security deposit varies widely with rental firms but is
specified in the tour description package or is quoted upon participant‘s
request. The security deposit is refunded upon return of the undamaged rental
vehicle. The rental contract is binding and the term of the rental is continued
even if the rental vehicle should become inoperable regardless of fault or
reason, or if the participant becomes incapacitated to commence or continue the
tour. In cases that a specified type rental vehicle is not available at the time
of rental pick up, we reserve the right to substitute with an equal value
vehicle. On a Guided Tour usage of the rental motorcycle is for the daily tour
only.
5. Hotel and
Accomodation
The pre-booked
accomodation is typical for the area and of a reasonably good standard.
Double-Room and Twin Room Booking are only available for participants who have
registered together.
6. Passport, Visa
and Vaccination Requirements
RMT is not
responsible or liable for any damage, expenses or inconvenience caused by the
participant failing to obtain required travel documentation or necessary
vaccinations. At this time there are no specific visa or vaccination
requirements for our tours. Please check the tour description package for
possible changes of the requirements and special country regulations.
7. Cancellation
by tour participant and penalties
Any
cancellations received by RMT on or before 90 days prior to tour departure, will
result for the deposit not to be refunded to the participant. For cancellations
received by RMT less than 90 days before tour departure the following penalties
apply:
89 to 60 days: 20% of the tourprice (if tourprice is less EUR/USD 2500 or NZD/AUD
5000 minimum deposit)
59 to 41 days: 30% of the tourprice (if tourprice is less EUR/USD 2500 or NZD/AUD
5000 minimum deposit)
40 to 31 days: 50% of the tourprice (if tourprice is less EUR/USD 2500 or NZD/AUD
5000 minimum deposit)
30 days or less: 100% of the tourprice
Any cancellation has to be made in writing. RMT accepts
transfer for one participant’s registration to a 3rd party for a
further registration fee of EUR/USD 50 or NZD/AUD 100 per person.
8. Cancellation
of the tour by RMT
In case RMT
has to cancel a tour for events out of their control (Acts of God, strike, war,
natural disasters) RMT shall refund all tourprice payments made. If there are
less than 6 Rider, the tour can be cancelled 2 weeks before tour
departure. In this case the participants are immediately informed of the
cancellation and all tourprice payments made are refunded. The participants have
no claims for any compensation or damages whatsoever against RMT, their agents
or service providers.
9. Liabilities
RMT, its
agents and representatives shall not be liable for any personal insury, property
damage or loss arising out of the participant in the tour and expressly disclaim
any liability for any injury, property damage and/or loss, delay, change of
itinerary, shortened vacation time, inconvenience or additional expenses. RMT
shall further not be liable for damages, refund or otherwise for mechanical
breakdowns, government actions, Acts of God, strikes, weather or any other
circumstances beyond RMT’s control. The above applies in a case where the
participant had followed the tour guides instructions.
10. Traffic
hazards
It is the tour
participant's responsibility to get acquainted with the applicable traffic rules
and regulations. Each participant is responsible for himsel/herself and for
damages inflicted onto other tour participants or members of the public and any
property. This liability is not excluded or reduced if the tour participant is
following the tour guides directions. Each tour participant must adjust their
driving according to their skills and concern for their own safety.
11. Complaints
Should any
participant have a complaint, despite the thoroughness RMT applies to planning
and execution of any tour, such complaint has to be made in writing to RMT
immediately. Any complaint or claim has to be received by RMT within 10 days
after the conclusion of the tour where the alleged event leading to the
complaint has occurred.
12. Photos, Film-, Video-
and Navigation recordings
Any rights for
photos, transparencies and videos (productions) produced by RMT and their
representatives during travel tours are fully owned by RMT. RMT reserves the
right to use such productions for advertisement, without granting royalties to
participants shown in the productions. Without prior written permission of
Reuthers, tour participants are not allowed to record Guided Tours on a
navigation device.
13. Recommended
Insurances
It is
recommended to take out the following types of insurance: Medical, accident,
general liability and loss of luggage. We will gladly assist you to source
suitable coverage.
14. Other
In the case of any provision of this document being void, this shall not affect
the validity of the remaining provisions in this document. Tour guides are not
authorised to grant rights or promise services different from the tour and
rental agreement. Verbal
agreements are invalid unless followed up in writing with confirmation of RMT.
In case of any dispute the jurisdiction of the appropriate court in Coburg,
